What you need to know
Family members of European Economic Area nationals can in certain situations retain their right to remain in the UK.
This can include:
- If your marriage or civil partnership has ended
- The person has died, and you lived in the UK for at least 1 year prior to this
- You are the child of an EEA national, their spouse/civil partner or their former spouse/civil partner who has died or left the UK and you were in education at the time, and continue to remain in education
- You are the parent and have custody of a child who has retained rights because they are in education
If you have previously applied for and were granted a Retained Rights Residence Card this will no longer be valid after 30th June 2021 and you will need to apply under the EU Settlement Scheme in order to continue to live in the UK.
The exact requirements can be varying and specific to your individual circumstances.
