What you need to know

A Derivative Right is given to those who identify themselves as Primary Carers or main carers of:

  • Someone who has the right to live in the UK
  • A child of a primary carer
  • The child of a former worker of an EEA state and you are in education

As a primary carer you will need to demonstrate that you are the main carer for someone or share equally responsibility for someone’s care and you are their direct relative or legal guardian.

If you have previously applied for and were granted a derivative right Residence Card this will no longer be valid after 30th June 2021 and you will need to apply under the EU Settlement Scheme in order to continue to live in the UK.

The exact requirements can be varying and specific to your individual circumstances.
