What you need to know
An EEA Family Permit makes it possible for family members of European nationals who are not EEA nationals to travel or join them in the UK.
Once granted the EEA Family Permit, holder(s) can live and work in the UK based on being a dependent of a national of the European Economic Area (EEA).
You must be the EEA national’s spouse, civil partner, or related to them (or to their spouse or civil partner) as their:
- Child or grandchild under 21 years old, or dependent child or grandchild of any age
- Dependent parent or grandparent
You can apply as an ‘extended’ family member’, for example a brother, sister, aunt, uncle, cousin, nephew or niece.
You must be able to show that you are dependent on the EEA national, are a member of their household or have a serious health condition and rely on them to care for you.
You can also apply as an unmarried partner if you can show that you are in a durable relationship with the EEA national.
EEA Family Permit applicants must satisfy the following requirements:
- The EEA-national partner must be exercising his or her Treaty rights in the UK
- The non-EEA family member and the EEA national must either be legally married to each other or be able to provide evidence of living together within the most recent two years.
- The non-EEA family member and the EEA national must have met.
- The non-EEA family member and the EEA national must demonstrate intent to live together.
- The non-EEA family member and the EEA national must be travelling to the UK together, or the EEA national should already be in the UK.
- The family unit must not be dependent on public funds whilst in the UK
EEA Family Permit holders are free to leave and enter the UK as many times as they wish within that six-month period.
After 30thJune 2021 this category will close to everyone.
